A Will — the central part of many estate plans
A will determines how your assets will be distributed after your death. If you die without a will, or intestate, the state will determine the distribution; it may not be what you would have wanted. In addition, your will may specify whom you wish to be the guardians of your minor children. It can also give instructions to the executor, such as selling a business or a particular piece of property. Most wills are pour-over wills which fund a living trust for the benefit of the heirs.
Other parts of every estate plan
Other critical parts of the estate planning process include drafting a:
- Living will, which outlines the medical treatment you prefer at the end of life or if you should be unable to communicate your wishes. Also known as health care directives.
- Durable powers of attorney, which give another person the authority to act for you in financial or medical matters if you are unable to make decisions in either or both of these areas. Also called a health care proxy.
- Land trust, an Illinois instrument that allows for the transfer of real estate without the probate process.
