Reckless driving examples
By statute, reckless driving occurs when one "drives any vehicle with a willful or wanton disregard for the safety of persons or property" or " knowingly drives a vehicle and uses an incline in a roadway, such as a railroad crossing, bridge approach, or hill, to cause the vehicle to become airborne."
Essentially, a law enforcement officer will cite you for reckless driving if he or she finds that you are driving in a way that is dangerous under certain conditions. For example, if the road is icy or wet, the speed limit may be too fast for the condition of the road and you can be cited. Other circumstances that may lead to reckless driving charges include:
- DUI
- Illegal lane changes
- Speeding excessively above the limit
- Racing
If you have received a ticket for reckless driving, it is important to seek the counsel of an experienced criminal defense attorney. Contact Addis, Greenberg & Schultz to learn how we can defend you against the charge and help you retain your driving privileges.
Aggravated reckless driving
Certain circumstances lead to enhanced charges, called aggravated reckless driving. These can include a child in the car when the offense was committed, prior convictions, or blood alcohol level above a certain level. Such circumstances can lead to more points being levied against your driving record. If someone was injured or killed, you can be convicted of felony reckless driving.
